PRACTICE AREA:
The law firm of Ann Toney, Lawyer defends clients charged with Driving Under the Influence of Drugs (DUID) and Driving While Ability Impaired by Drugs (DWAI-D).

DRIVING UNDER THE INFLUENCE OF DRUGS defense includes:

  • Advising clients prior to being stopped for DUID.
  • Advising clients after they have been arrested for DUID.
  • Reviewing the discovery in a case once a client has been charged.
  • Preparing motions for court.
  • Handling motion hearings.
  • Assessing a DUID case to determine what else is needed to defend.
  • Negotiating a plea with the prosecutor on behalf of a client.
  • Taking a case to a jury trial after a plea of “Not Guilty”.
  • Defending a client who is on probation and who is charged with a violation.
  • Understanding the science of drug categories and composition.
  • Understanding the science of drug testing.

What is important to remember is in addition to the usual constitutional defenses; the defense to DUID is a scientifically based defense.  There are many scientific aspects to defending: the blood draw, the blood analysis, the urine analysis, the Drug Recognition Expert/Evaluator (DRE) analysis and the research backing up the government’s claims, to name a few. To offer her clients the very best defense Ann spends much time taking specialized courses and training in the science of defending DUID cases.  Some of the recent trainings include:  NORML Aspen Legal Conference (June, 2010); Drug Evaluation and Classification Training (April, 2010); Standardized Field Sobriety Testing (SFST) (January, 2010); Defending Drug Cases (October, 2009); and All Things Cannabis (September, 2009).  Ann is certified by the National Highway Traffic Safety Administration on Standardized Field Sobriety Tests (SFST).
